The following Terms of Use outline your obligations when using the OnBoardHost website. You can also review our Privacy Policy, which outlines our obligations and practices towards handling any personal information that you may provide to us.
Your relationship with OnBoardHost.com
Your use of OnBoardHost.com’s products, software, services and web sites (referred to collectively as the “Services”) subject to the following Terms of Service (“Terms”), which may be updated by us from time to time without notice to you. OnBoardHost.com is owned by OnBoardHost. Hereafter, “OnBoardHost” refers to OnBoardHost. Any sub-sites Content are not owned by OnBoardHost.com nor do we advocate nor condone any sub-sites that users create on our network of free website providers. If you have an abuse, hate speech, or otherwise concern about a sub-site on our network, Please contact us immediately and we will investigate and resolve the issue as required.
Usage
All services provided by OnBoardHost may only be used for lawful purposes. The laws of the State of Georgia, and the United States of America apply.
The customer agrees to indemnify and hold harmless OnBoardHost.com from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email abuse@OnBoardHost.com with the information required. If the request is of a licensing issue, we may require further documentation.
You may only store website related files on your account. No Large video Storage, use another service, such as YouTube, to store Videos.
Using a shared account as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account. Please do not take backups of your backups.
Examples of unacceptable material on all our services include:
Violations of the Terms of Service will waive the refund policy.
Resource Usage
User may not:
1) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
3) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
4) Run any software that interfaces with an IRC (Internet Relay Chat) network.
5) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
6) Participate in any file-sharing/peer-to-peer activities
7) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
8) Run cron entries with intervals of less than 15 minutes.
9) Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
10) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”)
11) To help reduce usage, do not force html to handle server-side code (like php and shtml).
12) Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.
INODES
The use of more than 250,000 inodes on any shared account may potentially result in a warning first, and if no action is taken future suspension. Accounts found to be exceeding the 100,000 inode limit will automatically be removed from our backup system to avoid over-usage, however databases will still be backed up. Every file (a webpage, image file, email, etc) on your account uses up 1 inode.
Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and choose “Mail”, then “Default Address”, “Set Default Address”, and then type in: :fail: No such user here.
Backup Limit
Any shared account using more than 8 gigs of disk space will be removed from our off site weekly backup with the exception of Databases continuing to be backed up. All data will continue to be mirrored to a secondary drive which helps protect against data loss in the event of a drive failure.
Backups and Data Loss
Your use of this service is at your sole risk. Our backup service runs once a week, overwrites any of our previous backups made, and only one week of backups are kept. This service is provided to you as a courtesy. OnBoardHost is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on OnBoardHost servers.
Cancellations and Refunds
OnBoardHost reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.
Exchange rate fluctuations for international payments are constant and unavoidable. All refunds are processed in U.S. dollars, and will reflect the exchange rate in effect on the date of the refund. All refunds are subject to this fluctuation and OnBoardHost is not responsible for any change in exchange rates between time of payment and time of refund.
Customers may cancel at any time. OnBoardHost gives you an unconditional 5 day money back guarantee on managed shared hosting, and reseller solutions for any customer who paid the first invoice with a credit card or with Paypal.
Cancellations requested after the initial 5 days for Shared and Reseller accounts will go into effect on the renewal date for that particular hosting package. Unless specifically requested, the account will remain active until the period expires. If the account is eligible, any request for a refund outside of the initial 5 day period will be given on a prorated basis with any previous extended term discount withheld. Refunds are to be determined once the account has been canceled. Payments older than 60 days may require a refund via PayPal or mailed check due to our merchant account policies and procedures.
The following methods of payments are non-refundable, and refunds will be posted as credit to the hosting account:
There are no refunds on dedicated servers, administrative fees, and install fees for custom software.
Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
Accepting the Terms
In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms. You can accept the Terms by: clicking to accept or agree to the Terms, where this option is made available to you by OnBoardHost in the user interface for any Service; or (B) by actually using the Services. In this case, you understand and agree that OnBoardHost will treat your use of the Services as acceptance of the Terms from that point onwards. You may not use the Services and may not accept the Terms if (a) you are not of legal age to form a binding contract with OnBoardHost, or (b) you are a person barred from receiving the Services under the laws of the United States or other countries including the country in which you are resident or from which you use the Services. Before you continue, you should print off or save a local copy of the Universal Terms for your records.
Termination of Services
You acknowledge and agree that OnBoardHost may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at OnBoardHost’s sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform OnBoardHost when you stop using the Services. You acknowledge and agree that if OnBoardHost disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.
Services will automatically be terminated after 60 days of nonpayment. No refunds will be applied to accounts that are terminated for nonpayment. Backups will not be provided as the system will automatically remove backups of terminated accounts.
Refunds and Disputes
Servers are eligible for full refunds within seven (7) twenty-four (24) hour days of the creation of the server in our database. This point is not marked by the time at which your initial payment is processed and may differ by several hours or days. Refunds cannot be requested without probable cause. Services purchased via PaySafe are only refundable via account credit. All completed server upgrade orders are final and not refundable. In agreeing to this Terms of Service you affirm that your order begins within a 7 day “cooling-off” period, and we reserve the right to charge for the time utilized on your service prior to your cancellation.
Dedicated servers are eligible for refund within twenty-four (24) hours of the server being provisioned. As dedicated servers require explicit provisioning, we must charge a 30% restocking fee when refunding dedicated servers.
Payments sent automatically are eligible for a 100% refund of the renewal amount within one (1) day of the payment being sent. Refund requests between two (2) and five (5) days after the automatic payment may receive a 50% refund of the renewal amount. Automatic payments are not eligible for refunds beyond this five (5) day period.
We may require additional information in order to process any refunds. After receiving a refund request, we will reach out via e-mail to confirm. If a confirmation is not received, we are not responsible for any subsequent charges or late issuance of the refund.
Use of the Services by you
In order to access certain Services, you may be required to provide information about yourself as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to OnBoardHost will always be accurate, correct and up to date. You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries). You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by OnBoardHost. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers). You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services). Unless you have been specifically permitted to do so in a separate agreement with OnBoardHost, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose. You agree that you are solely responsible for (and that OnBoardHost has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which OnBoardHost may suffer) of any such breach.
Your Password
You are responsible for maintaining the confidentiality of any password associated with any account you use to access the Service and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify OnBoardHost of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. OnBoardHost cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 5.
User Contributions
All user contributions including but not limited to comments, forum posts and screenshots become property of OnBoardHost.com and may be used as they see fit.

Content
All information which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated. All such information is referred to below as the “Content”. Content presented to you as part of the Services, including but not limited to advertisements in the Services and sponsored Content within the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content to OnBoardHost (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part). OnBoardHost reserves the right, but shall have no obligation to modify or remove any or all Content from any Service. By using the Services you may be exposed to Content that you may find offensive, indecent or objectionable. Your use of the Services is provided to you at your own risk.
Advertisers and Links
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that OnBoardHost shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service. The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because OnBoardHost has no control over such sites and resources, you acknowledge and agree that OnBoardHost is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that OnBoardHost shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
Intellectual Property Rights
The Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.
No Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” OnBoardHost, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS DO NOT REPRESENT OR WARRANT TO YOU THAT: YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS, (B) YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR, (C) ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, AND (D) THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. OnBoardHost FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. A SMALL PERCENTAGE OF USERS MAY EXPERIENCE EPILEPTIC SEIZURES WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE SERVICE. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SERVICE. IMMEDIATELY DISCONTINUE USE OF THE SERVICE AND CONSULT YOUR PHYSICIAN IF YOU EXPERIENCE ANY OF THE FOLLOWING SYMPTOMS WHILE USING THE SERVICE: DIZZINESS, ALTERED VISION, EYE OR MUSCLE TWITCHES, LOSS OF AWARENESS, DISORIENTATION, ANY INVOLUNTARY MOVEMENT, OR CONVULSIONS.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT OnBoardHost AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF OnBoardHost HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
Miscellaneous
No Third Party Beneficiary. You agree that there shall be no third-party beneficiaries to this agreement.
Entire Agreement. The Terms constitutes the entire agreement between you and OnBoardHost and governs your use of the Service, superseding any prior agreements between you and OnBoardHost with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other OnBoardHost services, affiliate services, third-party content or third-party software.
Choice of Law and Forum. The Terms and the relationship between you and OnBoardHost shall be governed by the laws of the State of Georgia without regard to its conflict of law provisions. You and OnBoardHost agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Fayette, Georgia.
Waiver and Severability of Terms. The failure of OnBoardHost to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.
